Oriental Surprises Travel Refund and Change Policy

At Oriental Surprises Travel, we adhere to the principles of clarity and transparency, ensuring travelers have access to all essential information before embarking on their personalized journeys. This page outlines our booking terms and policies, providing you with all the necessary information to make informed decisions when traveling with us.

We consistently offer favorable terms that prioritize your convenience, ensuring a smooth and enjoyable journey for you.

I. General Provisions

1.         Term Nature: These Refund and Change/ cancellation Terms (hereinafter referred to as "these Terms") constitute a specific agreement between the Company and you regarding the cancellation, modification, and refund of travel product bookings. As an integral part of the Company's "Service Terms," these Terms carry the same legal force as the "Service Terms."

2.         Scope of Application: This clause applies to all travel products booked through this website, including but not limited to group tours, independent travel packages, and individual service arrangements (such as flight, hotel, and ticket bookings). Refund and modification policies may vary by product type; please refer to the "Refund and Modification Guidelines" published on the product details page or order page for specific terms.

3.         Legal Basis: This clause is formulated in accordance with relevant laws and regulations, including the Civil Code of the People's Republic of China, the Tourism Law of the People's Republic of China, the Consumer Rights and Interests Protection Law of the People's Republic of China, the Provisions of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Tourism Dispute Cases, and the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Prepaid Consumption Civil Dispute Cases (effective as of May 1, 2025).

4.         Notice obligation: In accordance with the Interim Provisions on the Administration of Online Tourism Services and relevant consumer protection regulations, our company shall clearly inform you of the refund and modification policies through prominent means such as bold text, underlining, or pop-up notifications. Terms not covered by this notice obligation shall not bind you.

5.         Effect of Standard Terms: Pursuant to Article 26 of the Consumer Rights Protection Law, our company shall not impose unfair or unreasonable provisions through standard terms, nor shall it mitigate or exempt itself from civil liability for infringing upon consumers' legitimate rights and interests; otherwise, such terms shall be invalid. "Unfair terms" such as non-refundable payments, non-replacement of lost cards, and restrictions on card transfers shall be deemed invalid under the law.

II. Key Definitions

1.         Before the conclusion of the travel itinerary: This refers to the period from the effective date of the package tour contract until the complete conclusion of the travel itinerary. According to Article 65 of the Tourism Law of the People's Republic of China, "before the conclusion of the travel itinerary" may occur either after the commencement of the itinerary or prior to its completion.

2.         Necessary expenses: These refer to non-refundable fees paid by the Company to local tour operators or service providers for fulfilling the travel contract. According to the definition in the Model Text of the Group Outbound Travel Contract, necessary expenses include, but are not limited to: transportation costs (including booking deposits) for flights, buses, or ships; travel visa/annotation fees; hotel accommodation costs (including booking deposits); and per-person rental fees for sightseeing vehicles.

3.         Performance Assistant: Refers to natural persons, legal entities, or unincorporated organizations that have a contractual relationship with the Company, assist the Company in fulfilling its contractual obligations, and actually provide tourism services such as transportation, sightseeing, accommodation, catering, and entertainment.

4.         Force majeure: refers to objective circumstances that are unforeseeable, unavoidable, and insurmountable; see Article 6 of these Terms for details.

III. Risk Assessment

By booking a trip with us, I confirm that I voluntarily agree to participate in a journey that may involve numerous risks and dangers, including but not limited to:

?           Force majeure, civil unrest, or terrorism;

?           Roads, trails, hotels, and transportation facilities that may not meet the safety standards of developed countries;

?           High altitude, physical exertion, or illness in remote areas, where timely evacuation or medical assistance may not be available;

?           The negligence of us and our affiliates (non-intentional misconduct).

I acknowledge that the joy of traveling to new destinations and participating in adventure activities comes with certain inherent risks, which are part of the experience I have voluntarily chosen to embrace.

I hereby agree to assume full responsibility for my own safety and accept the risks of any and all delays, accidents, illnesses, injuries, psychological trauma, or death.

IV. Exemption of Liability

I confirm that the pricing for all our itineraries is based on the participants' acceptance of these Disclaimer and Risk Assumption Terms. Therefore, I hereby release and disclaim all liability on our part and that of our agents arising from my participation in any travel or adventure activities.

This disclaimer is legally binding on me, the accompanying minors, and my legal representative. I fully assume all risks associated with the trip and waive any claims against us to the fullest extent permitted by law.

V. Itinerary and Validity of the Quotation

Although we strive to provide the most accurate information, the itinerary may be subject to adjustments due to logistical factors such as schedule optimization, flight changes, or government policy updates. We will notify you promptly of any changes but shall not be liable for unforeseen alterations.

The trip price is based on the current cost and exchange rate at the time of inquiry and becomes final upon booking confirmation.

VI. Booking and Deposit

A deposit of 30% of the total trip cost per person is required upon confirmation of the reservation. The full payment must be made 60 days before departure. For reservations made within 60 days before departure, the full payment must be made immediately.

If the customer fails to pay the full amount within the 60-day period, we reserve the right to cancel the trip and forfeit the deposit.

7、Cancel Policy

?   If more than 60 days have passed before departure: the deposit will be forfeited.

?   4560 days before departure: A 30% deduction of the total group fee will be applied.

?   3045 days before departure: 50% of the total fee will be withheld.

?   No refunds are available if less than 30 days remain before departure.

?   No refunds will be issued after the trip departs.

By paying the deposit, you agree to the above terms and conditions established by us.

VIII. Insurance

All passengers must provide proof of medical insurance before departure. Medical insurance and travel insurance are essential in case of injury, illness, or safety threats during the trip. We can assist in recommending insurance providers, but passengers must purchase appropriate coverage independently.

IX. Passport and Visa

Passengers are responsible for ensuring they possess a valid passport and obtain the required visas. The passport must be valid for at least six months beyond the end date of the trip. We can assist with obtaining travel permits for sensitive areas in China (such as Xizang), but we cannot guarantee approval by government authorities.

X. Photography During the Trip

We reserve the right to photograph and publish photos during the trip. By making a reservation, participants agree to the use of their portraits in promotional materials. If you do not wish to be photographed, please inform the tour guide at the start of the trip.

XI. Passenger Liability

Each traveler is responsible for selecting a itinerary that aligns with their interests and physical condition. We will provide detailed pre-trip information and recommendations to assist travelers in making proper travel preparations. Participants must ensure they are in good health and carry all essential equipment listed in the pre-trip materials.

XII. Our Responsibility

We organize, promote, and assist in implementing travel programs by procuring services such as transportation, accommodation, and sightseeing from various suppliers. However, we assume no liability for any intentional or negligent actions of these independent suppliers or third-party service providers.

The booking of a travel itinerary constitutes the participant's confirmation that we shall not be liable for any accidents, injuries, costs, or losses arising from force majeure events such as third-party services, terrorism, vehicle malfunctions, or itinerary changes.

XIII. Dispute Resolution

Any disputes arising from the services provided shall be resolved through negotiation between the parties. If no agreement is reached within 60 days after a claim is filed, the matter may be submitted to an arbitration institution within China for arbitration in accordance with local rules.

14. Informed and voluntarily signed

I have carefully read and fully understood the reservation terms, including the cancellation policy, liability limitations, and participant responsibilities. I voluntarily sign this agreement and agree to comply with the above terms.

XV. Others

1.         Term Independence: This clause is an integral part of the Company's "Service Terms" and has equal legal force with the "Service Terms". In case of any inconsistency between this clause and the "Service Terms", this clause shall prevail.

2.         Term Updates: We may update these terms as appropriate in response to changes in laws and regulations or business adjustments. The updated terms will be published on this website. Significant changes will be notified to you prominently via pop-ups, internal messages, or emails.

3.         Interpretation Authority: This clause shall be interpreted by the Company. Where there are two or more interpretations of the standard terms, the interpretation unfavorable to the party providing the standard terms shall prevail.
